Higher SOx emissions may be permitted, but only temporarily...

From 2026-07-01, amendments enter into force to the Special Requirements for Large Combustion Plants, approved by Order No. 486 of the Minister of Environment dated 2001-09-28 ‘On the Approval of the Special Requirements for Large Combustion Plants’ (hereinafter, the Requirements).

Paragraph 14 of the Requirements has been amended. If an operator cannot comply with the sulphur dioxide limit values specified in its permit because the supply of low-sulphur fuel normally used under normal operating conditions in the KDĮ (combustion plant) has been interrupted due to a serious shortage of such fuel, it must submit a reasoned application to Aplinkos apsaugos agentūra (Environmental Protection Agency; AAA). Within 2 working days of receiving the application, AAA may grant an exemption and permit the operator to operate for no longer than 6 months without complying with the limit values specified in the permit.

Paragraph 15 of the Requirements has been amended. If an operator cannot comply with the pollutant limit values specified in its permit where the KDĮ operated uses only gaseous fuel and the use of another fuel would require the flue-gas treatment equipment to be dismantled, but must start using other fuels due to a sudden interruption in gas supply, it must submit a reasoned application to AAA. Within 2 working days of receiving the application, AAA may grant an exemption and permit the operator to operate for no longer than 10 days without complying with the pollutant limit values specified in the permit, except where maintaining the energy supply is critically important.

Paragraph 10 of Annex 3 has been supplemented. Any day on which more than three hourly average values are invalid because of malfunction or maintenance of the automated measuring system is considered invalid. If readings for more than ten days in a year are invalid due to such circumstances, Aplinkos apsaugos departamentas (Environmental Protection Department; AAD) must immediately require the operator in writing to take appropriate measures to improve the reliability of the automated measuring system.

The amendments provide flexibility during energy crises, while strengthening control and monitoring.
