Documents ensuring compliance with obligations are mandatory for:
Companies that use or dispose of waste, operate landfills, incinerate waste, or store hazardous waste for more than 6 months and non-hazardous waste for more than one year.
Waste handlers who, under legislation, must have a permit for waste use or disposal.
Organizations seeking to obtain or renew a waste management permit, as well as producer/importer organizations managing products, packaging, oil, batteries, WEEE, and vehicle waste.
Before starting waste use or disposal activities, when required by the permit conditions.
When changing the permit or its conditions (e.g., increasing the amount of waste, changing the nature of the activity).
When extending the validity of the permit or updating the technical regulations.
When required by the Environmental Protection Agency or other institutions.
One or more of the following documents are prepared and submitted:
Guarantee insurance contract
Bank guarantee
Maximum mortgage
The documents specify the amount calculated according to the amount, type, method of treatment of waste and applicable legislation.
The documents must be valid for the entire period of waste management activity until the permit is revoked and all decommissioning measures are implemented.
Documents ensuring the fulfillment of obligations must be submitted to the Environmental Protection Agency (or other authorized institution) before starting the activity, changing the permit or updating the technical regulations.
If the document does not meet the requirements, the institution may ask to clarify it or provide additional information within a specified period.
The amount of security for the fulfillment of obligations must be calculated according to the procedure established by the Minister of the Environment, taking into account the type, quantity and methods of waste management.
