Amendments to the LOJ Rules

On 2026-06-23, Order No. 620 dated 2002-12-05 ‘On the Approval of the Rules on Limiting Emissions of Volatile Organic Compounds Resulting from the Use of Organic Solvents in Certain Activities and Installations and on the Registration of Installations’ (hereinafter, the LOJ (volatile organic compounds) Rules) was amended.
Paragraph 23 of the LOJ Rules has been clarified: where a substantial change is made to an existing installation, or where, after a substantial change has been made, the installation falls within the scope of the Rules for the first time, the part of the installation in which the substantial change was made is regarded as a new installation. In other words, following any substantial change, that part of the installation is always regarded as a new installation, with no exceptions or additional conditions, for example in relation to emissions.

The exemption has been repealed under which, where the total emissions from the entire installation did not exceed the quantity that would have been calculated by treating the modified part as a new installation, the upgraded part could be treated as part of the existing installation rather than as a new installation and less stringent requirements could be applied.

Key differences

Aspect Provision applicable until 2026-07-01 Provision applicable from 2026-07-01
Flexibility ✔ Yes ✖ No
Assessment of emissions ✔ Included (an important criterion) ✖ Not included
Possibility of remaining an ‘existing installation’ ✔ Yes ✖ No
Stringency of regulation Lower Higher
Administrative obligation (notification) ✔ Clearly specified ✔ Clearly specified

The amendment enters into force on 2026-07-01.

Paragraph 37 of the LOJ Rules has been amended (enters into force on 2027-01-01): each year, by vasario 15, information on the consumption and use of organic solvents during the preceding calendar year and on the quantities of LOJ emitted into ambient air must be submitted only through IS AIVIKS (Environmental Information Management Integrated Computer System). The option is repealed to submit LOJ reports using Annex 5 to the LOJ Rules. The amendment to the paragraph sets out specific requirements for submitting information through IS AIVIKS and requires more detailed information:

37.1. operator data:

37.1.1. the first name and surname of a natural person or the name of a legal person;

37.1.2. the registration number of the legal person;

37.1.3. telephone number;

37.6.4. fugitive LOJ emissions:

37.6.4.1. quantity (t/year);

37.6.4.2. quantity as a proportion of organic-solvent use (%);

37.6.5. total quantity of LOJ emitted;

The amended LOJ Rules remove the option of submitting LOJ reports ‘in paper form’, outside IS AIVIKS. Business operators should already begin collecting detailed SDL (safety data sheets) for the materials used and monitoring the consumption and actual use of each material separately. They should also verify and, where necessary, update the company’s EVRK 2.1 classification.
